What is Mitigation?

Mitigation in criminal defense is an essential component of restorative justice. Restorative justice aims to repair the harm caused by crime and to restore relationships between victims, offenders, and communities. The focus is not just on punishing the offender but also on addressing the underlying issues that led to the offense, such as addiction, mental health issues, poverty, or trauma.


Mitigation helps to bring about a more restorative approach to justice by recognizing the humanity of the offender, and that they are more than just the crime they committed. It takes into account the individual circumstances that led to the offense and seeks to address those issues to prevent future offending. By addressing the underlying issues, mitigation can also reduce the likelihood of reoffending and promote rehabilitation.
